Use of website
1.2 This website may be used for your own private purposes and in accordance with these terms and conditions.
1.3 You may print and download material from this website provided that you do not modify or reproduce any content without our prior written consent.
1.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.
1.5 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

Exclusion of liability
1.14 We do not accept liability for any loss or damage that you suffer as a result of using this website.
1.15 Nothing in these terms and conditions shall exclude or limit liability for death or personal injury caused by negligence which cannot be excluded or under the law of the United Kingdom.
1.16 Your order will be processed and delivered without undue delay, no later than 30 days after your order has been placed.
1.17 Please allow for up to 7 working days for delivery following the dispatch of your order.
Cancellations, returns and refunds
1.18 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.
1.19 Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.
1.20 To meet the cancellation deadline, please notify us via email or phone about cancelling the order before the cancellation period has expired.
1.21 If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the order.
1.22 We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.
1.23 Once you have notified us that you wish to cancel the order, any sum debited to us will be refunded to you as soon as possible and in any event within 14 days of your cancellation.
1.24 You will not have any right to cancel an order for the supply of any of the following goods:
(a) medicinal products or services that are either dispensed on prescription or are available free under an NHS arrangement.
(b) a contract for passenger transport services - such as bus, rail or flight tickets.
(c) the supply of goods or services where prices are dependent upon fluctuations in the financial markets, which are beyond the control of the retailer.
(d) the supply of goods that are made to the customer's specification or are clearly personalised.
(e) the supply of goods that are liable to deteriorate or expire rapidly - such as a delivery of fresh flowers or meat.
(f) the supply of newspapers, periodicals or magazines.
(g) the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities if the contract provides for a specific date or period of performance - for example, hotel bookings, courier services, car hire, restaurant bookings and theatre tickets for specific dates.
1.25 In addition you will lose your right to cancel if you:
(a) unseal goods that are not suitable for return if they are unsealed, due to health protection or hygiene reasons.
(b) unseal audio, video recordings or computer software that were sealed at the time of delivery.
(c) combine goods with other goods after delivery so that they become inseparable.
Law and jurisdiction
These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.
Terms & Conditions of Sale
These Terms govern the sale by Baillie Business Supplies to you of Products for which you place an order that is accepted by us. Note that our catalogues and websites are intended for business users only, and we reserve the right to refuse service and cancel orders to non-business customers. No other terms and conditions shall apply. Your acceptance of the Products shall be deemed to constitute acceptance of these Terms.
You can order anytime at www.bailliebiz.co.uk or by phone on 01255 223223. Our lines are open Monday to Thursday 8.45am to 6.00pm and Friday 8.45am to 5.30pm. Although we aim to process all orders same day, if you order after 5.00pm or at the weekend please assume that delivery will be as if your order had been placed the next working day. By placing an order you warrant that you are a business user. All orders placed by you are subject to acceptance by Baillie Business Supplies. Baillie Business Supplies reserves the right to revise prices, limit quantities, correct errors in its catalogue and refuse orders at its discretion including, without limitation, orders from distributors, dealers and warehouse stores, or orders in a size that are unlikely to be for business purposes. If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. In the event that you order an item and the price published on the Site is incorrect for any reason, we will contact you upon discovery of the error to let you know the correct price and ask you whether you still wish us to fulfil your order at this price. We shall be under no obligation to fulfil an order for a product which was advertised at an incorrect price. Should we have fulfilled the order before discovering the error, we reserve the right to take back the goods and refund you the purchase price or charge you the correct amount. Except as may otherwise be permitted by applicable law, you may not cancel an order which Baillie Business Supplies has accepted without the agreement in writing of Baillie Business Supplies, which requirement may be waived by Baillie Business Supplies from time to time in its sole discretion. Prices are exclusive of VAT at 20% (subject to government alterations). Ownership and title remains with Baillie Business Supplies until full payment for products has been received.
Because we know how important it is to get the supplies you need, we aim (but do not guarantee) to deliver all orders the next working day, although certain items such as furniture may take longer (see below). Orders placed Monday to Thursday will be delivered the next working day. Orders received on Friday will be delivered the following Monday and orders placed at the weekend will be delivered the following Tuesday. Customers will be advised at time of order if this is the case. Baillie Business Supplies cannot be held responsible for any consequential loss due to late or non-delivery. Note that oversized or bulky items may require additional delivery time and some products are delivered to customers directly by the manufacturer and some manufacturers are unable to deliver outside of the UK mainland; Baillie Business Supplies shall endeavour to inform you of extended delivery times at the time you place your order. In any case, Baillie Business Supplies shall not be liable for any cost or damage caused by late or non-delivery of the Products. Any delay in delivery of the Products shall not give you a right to reject the Products or cancel your order. Baillie Business Supplies reserves the right to deliver the Products in instalments. Delivery times are between 8.00 am and 5.00 pm. We cannot specify an exact time when we will deliver. The delivery driver needs to obtain a signature for all parcels. If you are unavailable to accept delivery, your order may be left with a neighbour if they are willing to sign for it. Delivery to the UK mainland is free, unless stated at time of order. Please note we cannot deliver to PO Boxes or BFPO addresses. Timescales for furniture deliveries are usually between 3 and 5 working days, although certain ranges may take up to 3 weeks. Unfortunately we are unable to deliver and assemble furniture outside of the UK mainland. Please note that delivery days quoted are working days, and for some areas of Northern Scotland, the Scottish Highlands and the South-West delivery could take longer. Also additional carriage costs may apply to these areas. For further information on carriage costs or delivery timescales, please contact Customer Services on 01255 223223. Information regarding assembly services can be found on individual furniture ranges. Please note the use of an electric screwdriver for the assembly of chairs will void your guarantee.
Unless you are a Baillie Business Supplies Credit Account Holder, you must pay for the Products at the time you place your order. If you are an account holder, please be aware that under the terms of the Late Payment of Commercial Debts (Interest) Act 1998, we are entitled to levy interest and a late payment compensation fee on overdue debts. Credit accounts are not available for first time orders. If paying by credit card on an order and you require the goods to be delivered to an alternate address other than that which your credit card is registered to, we may need to verify your details before we can process your order. Baillie Business Supplies reserves the right, by giving you notice at the time you place your order, to increase the price of the Products to reflect any increase in the cost to Baillie Business Supplies which is due to any factor beyond its control.
You may return items within a 21 day period of the date the order was placed for a full credit. We will even collect the items free of charge. Just call 01255 223223 to arrange your free collection and full credit. However, if you are returning unwanted items after the 21 day threshold, you will only receive a partial credit of 75% of the original item value. All unwanted goods for return must be unused, complete, and in as new condition and in their original and unmarked packaging (not resealed with brown tape). Once the goods have been received back into our warehouse and their condition checked, you will receive your credit, either in the form of a credit note or direct to your credit card, if that was how you purchased the goods originally. If they are not in a suitable condition, we reserve the right to refuse issuing a credit. Products such as laptops, selected business machines and software (provided they are unopened and unused only) are excluded from our standard returns policy. Food and drink, made-to-order and personalised items are also non-returnable at any time.
6. Damaged, Missing or Faulty Items
If any items are damaged or missing from your order, please contact us within 24 hours of your delivery on 01255 223223. We will the investigate your claim and if acceptable, either directly replace the item or issue a credit
All products purchased through Baillie Business Supplies benefit from the manufacturer's warranty or guarantee, if any. Legally, this clause only applies to business customers. Please note that the use of an electric screwdriver for the assembly of chairs will void your guarantee.
Nothing in these Terms shall exclude or limit Baillie Business Supplies liability for fraud or for death or personal injury caused by its negligence or any other liability to the extent that the same may not be excluded or limited as a matter of law. Without prejudice to the previous sentence, Baillie Business Supplies shall not be liable for any loss of income or profits or for any indirect or consequential loss or damage of any kind howsoever arising and whether caused by the negligence of Baillie Business Supplies, its breach or non-performance or any of its obligations under these Terms or otherwise. These Terms set out the full extent of Baillie Business Supplies obligations and liabilities in respect of the sale of the Products. In particular there are no conditions, warranties or other terms, expressed or implied, as to satisfactory quality, fitness for a particular purpose or of any other kind whatsoever, that are binding on Baillie Business Supplies except as specifically stated in these Terms. Any condition, warranty or other term concerning the sale of the Products, which might otherwise be implied into or incorporated within these Terms, whether by statute, common law or otherwise, is excluded to the fullest extent permitted by law. If you are a consumer the exclusion of terms implied by law will not apply to you.
Baillie Business Supplies shall not be liable to you for any loss or damage which you might suffer arising from Baillie Business Supplies delay in fulfilling or failure to fulfil any of its obligations under these Terms to the extent that such delay or failure is caused by any circumstance beyond Baillie Business Supplies Ltd reasonable control. If due to such circumstances or events Baillie Business Supplies has insufficient stocks to meet all its orders, Baillie Business Supplies may apportion available stocks between its customers at its sole discretion. These Terms and any terms appearing on any order form to which these Terms apply constitute the entire agreement between you and Baillie Business Supplies relating to the Products. The failure of Baillie Business Supplies or you to enforce any of these Terms does not constitute a waiver of that term and shall in no way affect the right later to enforce the term. The invalidity or unenforceability of any clause of these Terms shall not adversely affect the validity or enforceability of the remaining provisions. No amendment, variation or addition to these Terms shall be binding unless agreed to in writing by an authorised representative of Baillie Business Supplies. Baillie Business Supplies may transfer any contract with you concluded on these Terms or any of its rights or obligations under any such contract. These Terms will be construed in accordance with the laws of England and any disputes shall be settled by the English courts.
10. Defined Terms
"Baillie Business Supplies" means Baillie Business Supplies Ltd, whose head office is at Shop 8, Mansion House Precinct, North Road, Clacton-on-Sea, Essex CO15 4DA. "Terms" means these terms and conditions of sale. "Products" means any products listed in this catalogue for which you place an order which is accepted by Baillie Business Supplies. "You" means you, the customer.
